UK Bankruptcy from Overseas
Q: I am an Australian citizen and I lived in England for around two years. During that time I built up some debt in England with a few credit cards and one loan. I have now returned to Australia and have no intention of moving back to England. Can I use you service as I am not a UK citizen?
We can confirm that you are able to use the service that we offer. You do not need to be a UK citizen to be able to apply for bankruptcy from abroad. As long as the debts were incurred in the UK and you lived in England or Wales (in the last 3 years) before you moved there should be no problems.
How to apply for bankruptcy in the UK from outside the UK
Yes-as long as you have lived in India for less than three years and you moved from England or Wales. We can offer you our foreign bankruptcy service which is available to people residing outside of the UK. It can be very difficult and expensive to return to the UK, prepare a bankruptcy petition and then file the bankruptcy. In many cases there are issues such as your “centre of main interest”.
You may wish to use our foreign bankruptcy service if you can no longer service these debts. In many cases the cost of living and average salary affects the ability to make payments and this can be highlighted in Countries such as India.
We can act on your behalf under power of attorney and submit your bankruptcy petition to the Royal Courts of Justice in London. We can also provide help and support both before and after the bankruptcy. Complete our short questionnaire for immediate assistance.
